Contractor Disputes

Constuction damage can occur when an adjoining property is not properly protected. When a contractor undertakes work, care must be taken that the work is done according to your agreement with the contractor, the approved plans, applicable codes, and trade standards.  In some cases, the project does not go smoothly and there are disagreements at the end of the project.  Occasionally, the contractor abandons the job before completion.  A contractor may also tell you at the end that the project cost is higher than agreed.  When these unfortunate events occur, the scope of the discrepancies must be assessed and all defects documented.

In many cases, applicable codes and standards, the approved plans, or your agreement are ignored by contractors trying reduce their expense or complete a job quickly.  Codes and standards are designed to protect the public and make sure work is done properly.  By including references to codes and standards in the reports, it becomes obvious how the contractor violated applicable codes and standards.

In performing these investigations, Heimer Engineering's Engineers analyze the building and assess the work performed.  If appropriate, photographs or measurements are taken to document the conditions at the site.

After examining the site, a report is prepared describing the conditions at the site and the codes, trade standards, and reference standards violated.  The reports are clearly written and help all parties understand the issues and damages.

If the case has to be litigated in a court of law, Heimer Engineering's Licensed Professional Engineers are ready to serve as expert witnesses in a court of law.In many cases, the clearly written reports can help facilitate a quick resolution.  If the case has to be litigated in a court of law, Heimer Engineering's licensed Professional Engineers are ready to serve as expert witnesses in a court of law.  Staff Engineers have qualified as expert witnesses in Federal Courts and at all levels of New York State Courts.
